Resmi Gazete\u2019 de yay\u0131mlanmas\u0131yla uygulanmaya ba\u015flam\u0131\u015ft\u0131r Arabuluculuk \u201csistematik y\u00f6ntemler uygulayarak, g\u00f6r\u00fc\u015fmek ve m\u00fczakerelerde bulunmak amac\u0131yla taraflar\u0131 bir araya getiren, onlar\u0131n birbirini anlamalar\u0131 ve bu suretle \u00e7\u00f6z\u00fcmlerini kendilerinin \u00fcretmesini sa\u011flamak i\u00e7in aralar\u0131nda ileti\u015fim s\u00fcrecinin kurulmas\u0131n\u0131 ger\u00e7ekle\u015ftirilen, uzmanl\u0131k e\u011fitimi alm\u0131\u015f olan tarafs\u0131z ve ba\u011f\u0131ms\u0131z bir \u00fc\u00e7\u00fcnc\u00fc ki\u015finin kat\u0131l\u0131m\u0131yla ve ihtiyari olarak y\u00fcr\u00fct\u00fclen uyu\u015fmazl\u0131k \u00e7\u00f6z\u00fcm y\u00f6ntemi\u201ddir. Arabuluculuk \u00f6z\u00fcnde ihtiyari olarak bir uyu\u015fmazl\u0131k \u00e7\u00f6z\u00fcm y\u00f6ntemi olmas\u0131na ra\u011fmen, \u00fclkemizde baz\u0131 davalarda bu yol dava \u015fart\u0131 olarak d\u00fczenlenmi\u015f bulunmaktad\u0131r. Dava \u015fart\u0131 olarak d\u00fczenlenen alanlarda bu yol denenmeden dava a\u00e7\u0131lmas\u0131 halinde, a\u00e7\u0131lan dava usulden reddedilecektir. Halihaz\u0131rda arabuluculuk \u00fclkemizde, \u0130\u015f Hukuku, Ticaret Hukuku ve T\u00fcketici Hukuku i\u00e7in dava \u015fart\u0131 olarak uygulanmaktad\u0131r.
